In a Monday filing, Special Counsel Jack Smith asked the Supreme Court to rule on whether former President Donald Trump can be prosecuted on charges relating to his efforts to overturn the 2020 election results, Fox News reports.

Smith’s Monday filing seeks to go around an appeals court that had initially been expected to handle the case. A federal judge had earlier ruled that the prosecution could move forward, though Trump’s legal team vowed to appeal the ruling.

Trump’s trial in the election interference case is set to begin in March.
“This case presents a fundamental question at the heart of our democracy: whether a former President is absolutely immune from federal prosecution for crimes committed while in office or is constitutionally protected from federal prosecution when he has been impeached but not convicted before the criminal proceedings begin,” prosecutors wrote in Monday’s filing.
Fox News host Mark Levin slammed Smith’s attempt to expedite a decision from the Supreme Court.
“There is NO reason the DOJ/special counsel needs an immediate decision from the Supreme Court on the issue of immunity. There is NO reason the Court should hurry up and decide this because the Biden regime and its prosecutor want a quick answer. There is NO reason this should be decided before the election EXCEPT the Biden regime and its prosecutor want this decided DURING THE ELECTION. This was never any reason for the speed with which this case is scheduled, period — no legitimate constitutional or legal purpose. The issue raised by the Trump lawyers is very, very important. And the issue arises because of the preposterous charges brought against the former president. The Court should handle this in due course, with the care and attention it deserves, not in a rush to judgment to accommodate the agenda of the Biden regime, its prosecutor, and the Democrat Party.”
